In general, the immigrant investor category requires three main elements: a qualified investment of capital in a new commercial enterprise which will creates at least 10 full-time jobs for US workers.
Under the current EB-5 regulations, the immigrant investor must invest at least $1,000,000 in capital unless the immigrant investor invests in a new commercial enterprise that is principally doing business in and creates jobs in a targeted employment area.
Step 1: Investor completes questionnaire and subscription agreement
Step 2: Investor transfers the investment capital and administrative fee to the Escrow
Step 3: Investor retains immigration attorney and files I-526 petition
Step 4: Once I-526 petition is received by USCIS, investment capital will be released to the project.
Step 5: Once I-526 petition is approved and priority date is current, Investor will apply for lawful permanent resident status and obtain 2-year conditional green card.
Step 6: Investor files I-829 petition within 90 days prior to the expiration of his or her green card.
Step 7: Once I-829 petition is approved, Investor receives permanent green card.
